Inspired by the words of Hon. Chief Justice Dr. Willy Mutunga to the effect that the Supreme Court should seize every matter that comes before it as an opportunity to pronounce high quality guidance on interpretation and application of the law, the Author has compiled a collection of the court’s precedents. Based on how various laws of Kenya, including the constitution, statutes, subsidiary legislation, doctrines and principles of Common Law should be interpreted and or applied in the course of determining the disputes, the Supreme Court has, in effect, generated a new jurisprudence.

Since Article 163(7) of the Constitution of Kenya 2010 provides that the precedent set by the Supreme Court is binding on all other courts, this collection presents the supreme judge-made law of the land. These decisions manifest beautiful pieces of jurisprudence valid in Kenya and the length and breadth of the Common Law world.
